Music Terms of Use

I reserve the right to request removal of any of the following on a case-by-case basis if necessary. In all of the below cases, you must credit the name “Lystrialle” and/or link to the original work. In addition, some songs may have different terms on a case-by-case basis, which will be denoted when applicable. In the case of derivative works based on my own, please keep in mind that both the following terms and the terms of the derivative work’s owner apply.

These terms apply to the music made solely by myself, and terms may differ for collaborative works (Myriad, etc.). If there are any further inquiries, please feel free to contact me.

Non-profit use

“Non-profit use” includes anything posted on the Internet publicly for free use, provided no fee is charged for accessibility and no money of any kind is earned (in this case “earned money” includes via methods such as YouTube monetization).

The following may be done freely:

  • For music in general
    • The song’s audio attached to a video made with the intention of emphasizing the video contents (animated video, PV with a significant number of drawings, livestreams, etc.)
    • One-time plays (online DJ rooms, online radio, etc.)
    • Remixes/rearrangements
    • Use in live events
  • For music in which the instrumental is being distributed
    • Cover versions using the original instrumental
    • Voice synthesis software files (UST, VSQx, etc.) intended to assist in the creation of such covers
  • For uploaded videos
    • The video footage attached to a remix/rearrangement or cover of the original song

(In summary: if you’re using it as part of something and you’re not just reprinting my work with one or two modifications, you can distribute it)

Commercial use

Herein “commercial usage” is defined as situations in which money changes hands for anything relevant to my work. This includes YouTube monetization, selling music, Patreon, and the like.

The following is allowed:

  • Small-scale distribution (doujinshi events, Bandcamp/other independent online shops)
    • Remixes/rearrangements in which a significant amount of the arrangement is done by the user (i.e. not simply the original song with a pitch/speed change)
    • Fanart based on the designs of original characters or designs based on licensed VOCALOID characters (provided adherence to the original VOCALOID character’s terms of usage)
    • Human vocal cover versions using the original instrumental
  • Ad-based monetization (such as YouTube’s) and Patreon (and similar services)
    • Remixes/rearrangements in which a significant amount of the arrangement is done by the user
    • The song’s audio attached to a video made with the intention of emphasizing the video contents
    • Human vocal cover versions using the original instrumental
  • Commissions in which the money is paid solely to cover the cost of labor
    • Remixes/rearrangements in which a significant amount of the arrangement is done by the user
    • The song’s audio attached to a video made with the intention of emphasizing the video contents
    • Cover versions using the original instrumental
    • Creation and distribution of voice synthesis software files intended to assist in the creation of such covers

Permission required

  • Use by a corporation or corporate entity
  • Large-scale distribution of derivative works (major stores such as iTunes, major labels, etc.)
  • Anything related to materials that were originally made on commission for a third party

Forbidden

  • Redistribution (both non-profit and commercial) of the unmodified or barely-modified music
  • Redistribution (both non-profit and commerical) of the unmodified or barely-modified instrumentals
  • Redistribution (both non-profit and commercial) of provided UST or VSQx files

Regarding Reuploading

I can’t possibly upload to every existing video and music community out there in every possible language, and so therefore I do not discourage reuploading onto sites I currently do not post to, especially for the purposes of translation subtitles. However, in such cases you must both link back to one of my original uploads and cite the name “Lystrialle”. Once again, I reserve the right to request removal of any of the following on a case-by-case basis if necessary.

Illustrations Terms of Use

The illustrations posted to this site, or to other websites such as deviantART, pixiv, Wysp, Tumblr, or Twitter, may be reposted to other sites as long as a link back to the original is provided. However, other than resizing or cropping, they may not be edited in any form.

Story and Setting Terms of Use

Derivative works (fanart, fanfiction, etc.) based on the story/setting and characters involved in creative works (music/illustrations, etc.) and/or posted on this site are allowed, provided it is clearly denoted what it is a derivative work of (i.e. does not claim to be an original work). Commercial usage is also allowed for individuals or small-scale groups of individuals.

Characters that are derivatives of other existing characters also must adhere to the original characters’ terms of usage; for instance, Story Teller and Lore Reader are still bound to Piapro’s Creative Commons license as it pertains to KAITO and MEIKO.
